I’m seeking legal advice regarding a property purchase in Chennai. I’m planning to buy a 3BHK apartment in Casagrand Cloud9, Sholinganallur. To be honest, I’m really excited about this apartment. The location is perfect for me, and I absolutely love the floor plan. However, I’ve run into some serious issues with the parent documents that Casagrand has provided.
Casagrand claims to have bought the land (4.87 acres) from Children’s Garden School Society. They’ve shared parent documents dating back to the 1970s and 1980s as proof of ownership.
Here are the details of the documents they provided:
* **Survey No. 307/2:**
* 490 cents (4.9 acres), Sale Deed dated 14.09.1979, Document No. 2382 of 1979, Purchased from Mrs. Chockkammal.
* 14 cents, Sale Deed dated 23.03.1983, Document No. 567 of 1983, Purchased from Mr. Nataraja Naicker & Mrs. Chockkammal.
* **Survey No. 310/2:**
* 160 cents (1.6 acres), Sale Deed dated 13.10.1980, Document No. 3289 of 1980, Purchased from Mr. S.V. Ekambara Naicker & Mr. E. Loganathan.Here’s where things get tricky:
* **Missing 1979 Sale Deed:** The 1979 sale deed (Document No. 2382 of 1979) is not showing up in the Encumbrance Certificate (EC) search.
* **Document Number Mismatch:** When I search the EC with Document No. 2382 of 1979, I find a completely different transaction than the one mentioned in the physical document.
* **Casagrand’s Response:** The sales team says missing 40-year-old documents in ECs is normal.
* **Bank Financing:** I’ve also heard that only private banks are offering financing for this project, and government banks are refusing to provide loans due to these issues.This raises significant red flags for me. Could this be a case of a double document or fraudulent land ownership? I’m extremely worried about the legal implications of buying this property, especially since I’m so interested in it otherwise.

3. What steps should I take to verify the authenticity of the land ownership and ensure a safe transaction, especially given the financing issues?
4. Should I insist on Casagrand providing more documentation or clarification, and what specific documents should I request?
5. The fact that only private banks are offering loans raises concerns. How significant is this, and what does it suggest about the project’s legal standing?I’m torn because I really want this apartment, but I don’t want to get into legal trouble down the line. I appreciate any insights or advice from those with legal expertise or experience in property purchases in Chennai.
