Hi everyone, hope you’re all doing well.

I need some legal advice regarding my mother’s ancestral property from her maternal side. My mother has two younger brothers, and she is the eldest among them.

        Background

My grandfather passed away in 2016, but the issue started almost 10 years before his death—something we only recently found out about. After his passing, we learned that he transferred two properties to one of my mother’s brothers( middle brother), completely excluding my mother’s , her younger brother and naani’s name.

We don’t have any lawyers in the family, but we recently found out from outside sources that my grandfather made one of my mamu the sole owner of all the properties before he died.

        The Current Situation

        Both properties are ancestral.

My mother never demanded any share, but now she wants to take a stand.

Family tensions have always existed, but after my grandfather’s passing, things escalated quickly.

Both of my mamu have cut ties with us and even forced my grandmother (Naani) out of the house. She has been living with us for the past 3-4 years.

We recently found out that my uncle is trying to sell the property.

        Our Questions

        1. Can my mother claim her share in the property?

        2. What legal actions can we take to stop the sale?

        3. Since the properties are ancestral, does my mother automatically have a right to them?
