        Hi, i got a campus placement in a firm during the placement season of my college in 2022. I started the job in june 2023. The offer letter had a mentioned CTC of 15LPA. In which, around 1 lakh was joining bonus. The joining bonus was credited in 2 parts, 1st part in my 1st month salary and 2nd part in 6th month salary. They also had a clause that if i left/terminated from the company before 18 months of employment, i had to return the bonus amount. In my 8th month of employment, the company laid off around 50% of the workforce, through ATR (ask to resign). No performance review was done for the layoffs. They simply gave 1 month extra salary, and didnโ€™t asked for the bonus amount when i was completing my exit formalities. Around 1 month later when i had received my 1 month severance salary also, they called and started asking for the bonus. I was not in condition to pay that moment, so i stalled their calls. After 1 month, they sent a legal notice regarding the non-fulfilment of bond.

        My question is, should i be worried about this as technically i neither willingly left the company nor i was terminated from the company as they never had any performance review, and you dont pay severance for terminated employees. Please guide me through this.

          The thing is what proof you have that they asked you to resign ?

            Do you have the proper documentation of when they let you go?

            Additionally, does it mention anywhere in your contract that termination is tied to performance review? Otherwise how are you making this connection?

              1) did you get Experience Certificate/Relieving letter already + 2) if you’re on probation when ATR was issued?
              If 1> yes and 2 is no,
              the company can’t do jackshit other than > blacklisting you for future hire only from only their org/sub orgs/(some does it for vendor/sub contracted employees too). You’re liable for severance package of 3 months as a FT employee + Accumulated PF. Ask them for sev pay for ATR.

              If 1 > no and 2> no,
              then as long as you don’t quote the experience and leave this exp out of your CV it shouldn’t be any problem, (for PF being declined/delay you can sue them). Again countet them with Sev pay but chances of exp will diminish.

              If 1> yes and 2> yes,
              again you’re good. No need to even respond to such empty threats. No need to pay, But you can kiss your relieving letter and exp goodbye.

              If 1> no and 2> no> Greet them politely and ask them to take back the notice and shove it inside the CEO’s a**e(ffs Don’t do this- atleast confirming your identity)
