March 8, 2025 at 8:49 amI was employed in a toxic environment for the past four months ( reputed hr firms know about the unhealthy work environment this company has and that’s why never asked me the reason for leaving and told me they never take this company as there client ).The situation became unbearable due to a toxic boss and uncooperative teammates, which led me to resign without having another offer in hand.I requested an early release citing health issues โ I had suffered a fall, resulting in back pain and wrist discomfort that made typing difficult. Additionally, I informed them that I wished to move back to my hometown to stay with my aging parents. Unfortunately, HR showed little concern for my health and insisted that I complete the full 60-day notice period while continuing to assist my manager.
During my notice period, which I was serving from home, I was minimally involved in work-related matters and was barely responding to phone calls or emails. Despite this, HR accused me of absconding. They later asked me to visit the office, where they collected my laptop, made me fill out the exit interview forms, and allowed my manager and HR to express their dissatisfaction.
Now, despite completing these formalities, HR has not provided me with:
relieving letter
salary slip
full and final (FnF) settlement
Form 16They are saying if my manager approves they would immediately release. The ex manager is not responding
Additionally, I was a Key Managerial Personnel (KMP) in one of the company’s entities, and they are yet to file the required Form DIR-12 with the Ministry of Corporate Affairs (MCA) to record my resignation.Given these circumstances, what legal recourse or action can I take to address this situation effectively?

March 8, 2025 at 10:52 amThey are required to provide all these documents to you. In my personal experience as a lawyer most employers fall in line as soon as you send them a legal notice. -
