I have been thinking about this for quite some time. It is not uncommon to find people posting about situations where defamation suits have been filed against them by services whom they have negatively reviewed on Google Maps or written about somewhere. Where and how is the line drawn between an honest review and a criminal defamation?
If a case is filed against me, I will have to spend a fortune behind an advocate to save myself and prove that I provided an honest review, not intending to defame somebody. And that amount of expenditure and stress will burn out any common man. Does that mean people should never post honest negative reviews to make others aware of their experience? How do courts do probable cause in these situations? How is the amount of a defamation suit decided by the petitioner? Are there any guidelines/precedents by the Hon’ble SC, or is it completely up to me/my advocate to make the Court understand that no defamation was intended, or the suit has no probable cause?
