UHi I’m 24 M currently based in Delhi but originally from Bombay. I just got out of a really toxic relationship.
So back in Mid October 2024 my Ex Gf borrowed 3 L from me because her older sister’s wedding had gone out of budget. The wedding was on November 10th 2024, and as I trusted my GF a lot I gave her cash. She promised me that she would pay this back after the wedding.
As soon as the wedding was over she broke up with me for seemingly no reason. I asked her why amd tried to speak to her about why but she was really vague. I had a suspicion she was cheating on me with her ex but she assured me that was not the issue. So I asked her to pay me my money back and we could at the same time work on reconciling.
After a lot of crying and painful days, we decided to give it another try and as such I got a bit lax on taking my money back.
Cut forward to March 14th, I found out she cheated on me w her ex boyfriend right before asking me for the money for the wedding. As such I obviously got really angry and shouted at her, and asked her to pay me back immediately or I would sue her. She left me on read and I thought nothing of it until I get a call at 3 AM from some police station saying that I was distributing pictures of my ex girlfriend and had raped her. I had done no such thing in fact we had only met for 3 days in February and had fought quite a lot where she scratched me and pulled a knife on me. I unfortunately decided to forgive her and stay with her after this incident.
Cut to today and apparently she’s filing a false case against me and is defaming me on social media.
I have evidence proving she took my money, and that our relationship was consensual.
consensual.Right now I need to know if I should file my case in Bombay or Delhi. And how I should handle the false allegations.

SAssuming she is misusing the law against you, this is what you should do:
1. If she lives in Delhi you file the case in Mumbai as part cause of action arose here. Make her run.
2. File a suit for recovery.
3. File a suit for defamation in Bombay. Ask for damages and injunction.
4. File FIR for cheating, criminal breach of trust and for filing false case.Act fast. Make her regret ever meeting you.

UCash I got from my family safe, multiple handouts in different locations like we once went for 4 days to Alibag a trip I completely paid for, btw. And I got my servant to bring around 70k in cash from Bombay to Alibag for her.

I’m not religious, I am an atheist but i keep praying God to kill me. Its the last thing i think about before sleeping and the first thing i think about when I wake up.
You already know a bit about what happens but i need to tell this to someone or I will suffocate.
I remember being very high, and i remember him asking me a lot of questions, that were triggering him. I do not remember that triggered me but I got really upset when he took my phone and wouldn’t give it back. I remember angrily looking at him , and him giving my phone back. But then he took it away again. Then i remember begging him to give it back. Hurting myself, he stopped me but I was out of control. He said that beat him up. And i remember scratching his face and his ear but i also remember doing all that in an attempt to get my phone back. That day i changed my phone’s password 6-7 times but in the end he had the password.
At some point i stopped fighting, and I tried to drink soap to kill myself. I remember falling on the bathroom floor 7-8 times. I was imbalanced but he shoved me everytime. And I fell again and again. I begged him to show mercy. My heart was racing very very fast, with a combination of weed, alcohol and worst of all fear. I felt like i was going to get a heart attack. I felt like i was going to die. I think some part of me was relived about that.
I begged him to show mercy he took everything from me, he transferred all my money to his account, he did a lot more things that even now I’m not aware about.
I begged him for mercy, I asked if I sucked his dick will he show mercy. He stopped me several times. But then he let it happen. I started sucking, I looked at him thinking he might show mercy now. I was crying and scared. He looked at me and told me that he is going to be cruel.
I wanted to die at that moment, and it keeps flashing in front of me. I stopped and did everything in my power to kill myself at the moment I banged my head on every surface. If he had let me i would have jumped off the balcony. I needed to die at the moment.
He keeps bringing up how I beat him up, and I pulled a knife on him. I didn’t pull a knife on him, I was trying to kill myself with the knife. He said that he was hugging me when I was scratching him, but i remember that. He hugged me very tightly and I kept asking him to let me go. It was very very tight… He destroyed me, he destroyed my soul and he believes that i deserved it because i beat him up.The next morning i woke up with my whole body aching. Several swelling on my head and bruises all over my body. If he didn’t beat me up, why do i feel beat up? Why do I feel like dying every moment ? He didn’t beat me up right.
Next morning when I had the illusion of everything being fine, and went ahead and took away my last piece of financial security.After begging him he let me come home

UYes, I have everything except the presence of parents. But the servant who brought the cash has since gone back to their village, so they can’t be a witness.

SAny call recordings discussing money giving or her using for wedding ? That will help a lot. I would suggest talking to her parents and record conversations around giving money. Or ask someone else common but not suspicious to discuss this money dealing with her and record her or her parents. Third party recordings can help a lot with your case. Good luck and be careful !

LYou may want to apply for anticipatory bail as well, if you feel you are likely to get arrested for the rape allegation. You would need to apply before the court having jurisdiction over the police station that reached out to you.

LTrue, but if there’s clear evidence of it being a false or baseless allegation then the chances are better. Here, if the rape allegation is filed after the texts regarding cheating, loan etc were exchanged then it would help to show that the complaint is a counterblast. LEven in non cognisable offences, there is a possibility that the magistrate may grant permission for arrest, or if the accused fears wrongful implication, anticipatory bail can still be sought. In this case, rape being a cognisable offence, the cops can arrest without approval from a magistrate – maybe you need to go read the bare act again

UHi, so she initially lent me money for my business. This was around 3 L, which I gave her back in July 2024. Post this, she wanted an additional 3 L for her sisters wedding, which was given to her in cash by me.
Also bro yes its 2025, but India is a very cash based economy still especially a financial hub like Bombay.
I have seen 1 and 2 cr change hands in cash for property deals. And I’ve also seen people deal in Benjamins for other deals. It’s very common if you’re in the right circles.
