April 1, 2025 at 6:51 pmI am based out of hyderabad and have been married for 4 years. It was a love marriage. Problems began since the beginning of the marriage. Now me and my wife are living like roommates. No physical intimacy for the last 2 years.Questions:
1. How do I prove this? I mean what proofs do I need to submit in court?
2. What should I do to protect myself and my family?
3. What are the chances of me having to pay alimony?
4. I’m debt ridden and on the verge of losing my job(lay offs). Will this be considered for the settlement? Also any idea how much would the legal costs come to?
Thank you in advance.

April 1, 2025 at 10:59 pmThe simplest way forward, especially with so many questions involved, is to consider mutual divorce. Since she is not interested in continuing the relationship, this could be a practical option. It helps protect your family and avoid unnecessary complications.Alimony and maintenance are generally mandatory as per the courtโs order, depending on your wifeโs request. The court will consider both her need for support and your financial capacity.
If youโre okay with it, letโs connect so I can explain everything in more detail.

April 2, 2025 at 6:41 am1. If you both are agreeing for Mutual Consent Divorce, you don’t have to worry about proofs, fake cases, alimony/ maintenance. Only condition is your wife should agree for the divorce as well as terms of separation. [https://divorcebylaw.com/mutual-divorce-lawyer-in-bengaluru/](https://divorcebylaw.com/mutual-divorce-lawyer-in-bengaluru/)2. If you are going for a contested divorce, you need a ground on which you ask for divorce, for which you need to show some evidence (not very strict as in a criminal case) to prove your ground. It could be messages exchanged, videos or photographs proving the same. Understand the grounds through this write up [https://divorcebylaw.com/best-contested-divorce-lawyers-in-bangalore/](https://divorcebylaw.com/best-contested-divorce-lawyers-in-bangalore/)
3. Paying alimony & maintenance is decided on case to case basis. Assets & liabilities of both the spouses are checked. If your are bankrupt or unemployed and your wife has source of income, you don’t have to worry about paying the alimony/ maintenance. however, she can ask but you need a strong representation to counter that. If your wife accepts for divorce it will hardly take 6 months to get the divorce and settle your matrimonial dispute or else it may take longer even for settlement and close your disputes. Regarding the maintenance it depends on your financial status at the time of maintenance case. So you need not worry about maintenance if your wife accepts for divorce and settlement. Try to solve your disputes.
