Can someone please clarify the wordings of the Maternity Benefit Act:”worked with the employer for at least 80 days in the 12 months preceding her expected delivery date.”

Scenario: if I work at a company for 5.5 months (initial 3 months probation, then confirmed), am I eligible for 26week Maternity leave?

Hi. I’m a lawyer here. Yes, you’re eligible. Say the delivery date is 30th June 2025 and you started working with your employer on 30th June 2024, you need to have worked for atleast 80 days within that period, to be eligible for maternity leave. It’ll include your probation period.
