        I walked in to a hospital with a kitchen accident to my thumb and asked the doctor to perform all the checks before closing and specifically told them that I am ok with being taken to OR since I can give my insurance id if the procedure is long.ย 

        However, the request was dismissed saying they don’t think it is necessary and sutures were done on a superficial level while after a few days I now noticed that there is sensory loss in the finger.

        I referred to a second doc who said the damage may be permanent.
        What legal recourse should I take?

          Hi. Iโ€™m a lawyer here. I think itโ€™s best that you first take care of your finger and ensure that itโ€™s cured well. After that, you can surely sue them under the Consumer Protection Act, if you have enough evidence in favour of what youโ€™re asserting.

              I have full mobility but sensory feelings are gone.

              Now, the problem is I requested them to check everything but the ER doc did not.
              Also, I dropped an email to state medical board with all the details and CC’ed the hospital.

              Now, what will I need to prove that this was negligence.

              Your case summary from the previous doctor. Findings of the new doc and probably another opinion on it, to begin with.

                You can file a case before the Consumer Commission on the ground of deficiency in services and seek compensation for that.
                Make sure to collect all the medical documents from both the doctors and make sure you have enough evidence to substantiate your claim.
                Procedure is that court might seek expertโ€™s opinion in your case that whether the procedure followed by the first doc was as right as per medical rulebook or not.
                You have to file the case before district consumer commission
