February 24, 2025 at 3:02 pmSuppose a working professional in a private firm has transferred money online as a bribe to a unknown third party person online using UPI to help him secure a position in another company for employment purpose, but later on that third party person backs out of said promise and not returning the money back or call, so in this case is the person giving money as a bribe for employment in a private company liable for any punishment under any Indian law and what can be done to recover money back? -

February 24, 2025 at 3:28 pmLegally no company takes money to hire people so it is either a scam or an illegal arrangement.Since money is given to 3rd party, no point escalating to the company however if some employee suggested you do this, you can put that person’s name. Or seek his help in getting your money back.
A civil suit can be filed but you are yourself indulging in an unfair practice so not recommended.

February 24, 2025 at 4:16 pmYou cannot approach the court with unclean hands. If the money was given for an illegal purpose it does not constitute a valid contract and is not recoverable in Court.
