        Hello, my wife and me agreed to do mutual consent divorce, I agreed to pay her x amount of money.

        As its two step process in court, 1st sign followed by 2nd sign after 6 month.

        As a man, It will be much help to understand what can I do to make sure she will not cause any problem during 2nd sign.

        We will be doing 1st sign on 5 february.

        Reason for divorce she had affair and she is toxic.

          First of all did you give the time waiver application if it is applicable in your case?
          Second she can create a problem but at the first time infront of the mediator you have signed so the mediator sent the report to the court.
          After that if she creates a problem then this case will transfer into contested divorce. So its better to maintain peace with her till than.

                  Thank you for repling, my lawer keep saying, its not possible, 6 month is mandatory, is there way to know waiver is applied to which situations?

                      He/she is partially right as a lot of courts makes the cooling off period mandatory but on the flip side it can be filed after one week after completion of first motion.

                        Waiver is applied if it’s mutual, if parties have already been separated and persuaded there is no grounds for reconciliation. Friend just got his waiver after one month.

                            Makes sense, then I wonder why my lawer is not pursuing waiver path?

                                The higher courts have issued guidelines which take time for lower courts and lawyers to understand. My friend’s lawyer too was unsure, then another lawyer advised to cite higher courts.

                          1. In case of mutual consent divorce, generally both the spouses are in consensus. However while waiting for 6 months, there are chances that your wife may change her mind. So, you can waive off the 6 months cooling period through an application and get the divorce settled faster.
