MHello everyone I am 21 y/0 (F) is with my current partner (20 M) who’s is the most kind and caring person I have ever met. Yesterday we had a huge fight after which he went back home to discover his youngest uncle lying unconscious on his bed ( which was very usual since he had severe drinking problem, and most often was rushed to hospital by my bf)
He realised he wasn’t breathing and took him to the Safdarjung hospital where he was pronounced dead.
Later, the police ruled it out to be a murder case and has ever since detained my bf since 12+ hours now, I haven’t heard from him in 3 hours and he isn’t home, his phones is switched off what should I do??
Please I beg of u to help me here!! -

SNothing you can do? If he’s suspected for committing a crime and detained by the police, he’ll be presented before a magistrate within 24 hours of such detention, at which point it’ll be decided if further detention is required or not.

SLook, I get what you’re talking about, but it is a murder investigation – you’d rather it be thorough. It’s quite necessary.

SLook if someone behind it who filled a complaint so it’s thing to worry go and talk to them who filled complaint.
If nobody file complaint and police just doing investigation so don’t worry. Even if your bf and his father actually guilty they’ll definitely get the bail easily.
Was his uncle have a family behind him? Like wife, childern so go and talk to them

SLook if police didn’t took them into Lockup so it’s not a formal arrest because when police arrest formal and took them into Lockup there legal rights got activated. And they have to present them in front of megistrat after 24 hours of arrest.
When no FIR or complain registrd against them they can do informal arrest they don’t have to present them in court they can take them into custody for long time.
Ask your lawyer to complain about it to senior officers SHO or DSP.
Or contact Human rights Helpline
Because informal arrest isn’t allowed.

SHe is only being detained by the police and is not being sent to judicial custody, right? Let the police do their job, he will be let out. If he is being arrested and taken into judicial custody, you will need the help of a local lawyer, and you will have to get him out on bail.

BA person cannot be detained for more than 24 hours without an order from the Magistrate. Since only 12 hours has passed, wait until the remaining time passes. If he is not released after that, immediately contact a lawyer.

MI don’t know, we r planning to contact the lawyer and ask for the details. It’s going to be 24 hours in about 1.5 hour idk they are not back. Idk how long it is going to be. He’s literally having to pay for helping someone.

UFirst of all hire a criminal attorney they have better access in police departments. He wasn’t even there when the uncle passed away that should be easier to prove. I hope it all turns out good for him.

RGET A LAWYER!!!! (If you can’t contact me personally) They can’t speak rudely to you first of all, and you have a right to stay there, ask them under what charges they are taking him under? After 24 hours it’s the rule they have to take him to the magistrate. If they are keeping him more than that, just go to a lawyer, she will deal with it.

MThey said higher ups involved, and they r pursuing the murder angle, they have all the proofs and still.. they won’t release them, says they were brought in the evening around 6 pm.

ATu thoda dur rah, murder case ki investigation hai, uske papa hai na uske saath, wo dekh lenge, post mortem report ke baad I’m sure he will be released if he have nothing to worry about.

SThey are keeping him for investigation. He is probably not under arrest also. Get a lawyer immediately. He will find out and proceed with the next course of action. Based on what you say, he should be clear in a week or so

MRight they are being held, we r talking to our lawyers idk what they r upto m not being told clearly, A week is too long. We also have our exams end term it’s going to be such a mess.

SLegal process takes time. He will be lucky if he comes out without his name being dragged in the case. He can appear in exams next year.

Not ruined, but a momentary setback, which is way better than being named in the chargesheet for murder

MBeing charged for money even tho the culprit and murder weapon was found, they even took the cctv.
