I am a budding entrepreneur.
I had an employee. Who was a sales person.
Sold few products through him to some clients.
He was not performing well
So I told him jan 31 2025 will be his last day
Made a mistake did not give written notice.Now he went to some of my client took payments from them and from some clients he took material.
What shall I do in this case.
Which lawyer to contact will it be viable to persue legal as we know legal system of India is a big can of worms opens up and stays with you for eternity.Any lawyer in this forum kindly help.

February 26, 2025 at 4:34 amCover your losses, save your relationship with the clients as you are still starting and go after that f*cking thief of an employee with everything you’ve got, personally. Consult a good criminal lawyer and discuss options. Even if you can’t get the money back from him immediately, drag him to court and make him pay. -

2. Get an advocate to recover the money
3. Reach out to your clients whom he scammed
4. Salvage those clients as much as you can.
5. Tell them what happened and try to work out a solution.-

February 26, 2025 at 5:32 pmFir an FIR. Recover the money, be nice but donβt be a pushover.If you donβt, you will set the wrong example in front of other employees. Had this happen to a friend, he filed an FIR recovered the money and it set an example for other employees. No employee ever has fβd around with him again.

Give them the remaining months salary and all their other dues like unpaid vacation days, casual leaves etc. Give them a written notice and fire them on the spot.if you give them a long notice and allow them to stay in the company for 2-3 weeks more – they can and will internally sabotage the company. Steal data, Steal clients, Steal money, Steal computers, laptop etc.
Always fire them on the spot and take all company given things like laptops, mobile phone, access to email/database, keys, change passwords etc.
Tell them to take all their personal belongings with them & tell them accounts will clear all their pending dues.
Sounds cruel, but sadly that’s the right way to do things in India to protect yourself, your business, your clients and your other employees in the company.
You don’t want a disgruntled, vindictive and pissed off employee hanging in the company for 2-3 weeks more!

March 3, 2025 at 10:51 amNAL first legal notice to the employee. Then FIR.If you can’t trace him, file an FIR for theft to the police.
Also lawyer up incase the client files a complaint case against you. Try and salvage whatever relationship you have left.
