April 27, 2026 at 5:42 pmMy friend’s sister is staying in a hostel in India and is the only Muslim among her roommates.She has asthma, so one day she opened a window for ventilation. Near the window, one of her roommates had kept a Hindu idol, and because of the airflow, a sacred thread/decorative item tied to it got displaced.
The roommate assumed she had done it intentionally because of religious bias, even though according to her it was accidental and she only opened the window because of her breathing condition.
After this incident, the matter was escalated to hostel staff and management. Since then, she says she has been facing harassment, isolation, and hostile behavior in the hostel.
There was also a shared/common chair used by the group, but the hostel warden removed it and refused to return it when asked.
Things became more serious when, due to stress, she expressed suicidal thoughts. Her mother informed the hostel warden about her mental condition, but according to the family, the warden responded dismissively with comments like “do whatever you want” and “I don’t care.” Unfortunately, the call was not recorded.
Additionally, the hostel principal allegedly made comments implying that she is mentally unstable, which made the family feel she is being blamed instead of supported.
Main question: What would be the best legal course of action in India in this situation?
Also, if the family files a complaint mainly based on her statement and surrounding circumstances (without recordings), is there any realistic defamation risk?
