April 30, 2025 at 5:17 amSo my uncle(my mom’s brother) filed a case against his aunt that he have gave him a loan of 10L and they haven’t returned it yet and for that he asked my mom to sign as a witness and said there is no need of you to come to court and its a pitty case but my mom doesn’t know anything about it and signed as a witness, and now my dad is really tensed about my mom getting to court. as she really doesn’t know what happened she don’t want to be a witness and support my uncle soo is there any possible way for my family to escape from this??my parents are really tensed about this….there is a fight happening about this in home daily and i don’t know how to even discuss this with any of my friends….soo i really appreciate anyone’s help here

April 30, 2025 at 5:34 amHi. I’m a Delhi based lawyer. What has she signed? Has she signed the evidence by way of affidavit to be filed on her behalf? Or her name has only been included in the list of witnesses yet? Even if she’s signed the former, tell her not to show up when it’s time for her cross examination and gradually her right to be cross examined will stand closed.-

April 30, 2025 at 6:05 amOkay are you sure? Because your post suggests otherwise. However, if shes not been made a witness to the proceedings yet, it’s fine. Just tell her to stay put and not sign any other document.-

till now she hasn’t been to any witness proceedings
if we didn’t appear in court when we received an order is it okay then?and iam sure she only signed in the promissory note

April 30, 2025 at 6:11 ami meant she hasn’t been in any proceedings and when the time of proceedings if courts asks for witnesses to come in and we are absent to the court is it okay??-

April 30, 2025 at 6:16 amShe will only be called to court if your uncle adds her name to his list of witnesses to prove the facts of the case. She can also choose not to file her evidence. Either he can be told upfront not to add her or she can choose to not appear when it’s her turn and let her right be closed. Either way she can evade appearance. Don’t think there’s any cause of worry yet. Thanks.-

April 30, 2025 at 7:33 amyou can tell your uncle she wont testify in court and in case she is called to court she is going to say she didnt sign the document or its not her signature
