March 24, 2025 at 8:30 amMy parents Booked a bus through redbus from pratapgarh to nagpur yesterday for returning home. This morning around 4:30 near jabalpur , their bus got into an accident resulting in death of some passenger and many more are injured . It was so tragic people lost arms or legs . Thankfully my mom and dad are rescued and also injured . The bus was rash driving and slipped due to driver dozing off ,ended up losing the balance of bus and turning upside down. I am so panicked rn and can’t understand what to do. My mom lost her phone and it’s been stolen I asked them to register a complaint for phone which had imp stuff , its switched off where can we get it tracked? We lost personal belongings too and my mom had to be taken to the hospital which resulted in bill of around 15000 plus the phone was of 22000 and we had to book another vehicle to reach home as bus service didnt help. What else can we do? Where can we file a complaint against bus services, is there any govt official website for that? Will doing a FIR worth or waste of time? We didnt even get refund for the bus tickets.The bus service was prassana purple ram rath which had good rating as well.There is no response from red bus yet.The driver and conductor fled from the scene and didnt take any accountibility to make people reach homes. Around 15 passengers are severly injured, out of all of 36 people only my dad was able to get out and stand on his legs . He rescued my mom by breaking the glass and also helped to get other people out till the ambulance arrived.
If the bus was turned on the right side there was no way they would have been saved cause people literally got crushed. I am just so still shocked knowing the fact that I would have become a orphan in seconds. Negligence of such drivers is very common ,would suggest people to not book overnight buses for long distances.

March 24, 2025 at 8:38 amI hate to say this but you can fight but you cant win against them. I lost one of my parent in a crash and believe me its waste of time and it drains your mental health. just consider yourself lucky and move on. -

March 24, 2025 at 8:39 amKeep copies of the tickets with you, you can file a motor accident compensation case, as well as file for mediclaim if you have a valid policy.
Also, get a copy of the police complaint filed in this case. -

March 24, 2025 at 8:48 amThere is a motor accident claims tribunal where accident victims file claims (through lawyers). The tribunal is like a court which holds hearings. The opponent is not the the vehicle owner but the insurance company which has provided the third-party insurance to the bus. Usually it is the MACT lawyers who approach the victims to get their signature on the vakalatnama and fight the cases pro bono (which means that they will not charge any fees but take a share of the award if and when awarded by the tribunal). The MACT assesses the claim based on loss of income, medical expenses, and disability. -

March 24, 2025 at 8:50 amYou can file a complain in consumer court for negligence of service as they didn’t help with medical and other things. Most likely you will win that but if you go deep in things like reckless driving etc it’ll be hard.Additionally you can claim the medical expenses from insurance company.

March 24, 2025 at 9:37 amIt has to be done via an advocate, who specialises in MACT cases. They usually work on % basis and the going rate is 20-25% of the compensation amount. It will be filed in a MACT court and the insurance company of the bus is liable to pay the compensation which is awarded.Also, Keep all the expense reports/bills, taxi bills, original tickets etc.
Edit: additionally, all banks/debit/credit cards usually have a personal accident cover included in them. Check if your parents have any of them.

March 24, 2025 at 2:51 pmIf you book an air india flight ticket via Cleartrip and it got in a crash will you sue Cleartrip …or IRCTC in an train accident?? How are they responsible ? Its between you and the bus operator obviously . You won’t stand a chance in court if you drag Redbus in this

March 24, 2025 at 9:08 amFocus on your parents health first. As for the compensation, did you opt for the travel insurance while booking? If yes, then you can claim that insurance.An accident is an accident and should be treated as one, not a money minting opportunity.

Asking because maybe you need to revisit the chapters on liability.“An accident is an accident” whereas the IPC allows prosecution for death as a result of negligence (which seems to be the case here). Look up section 304-A and then come back and apologize to OP for bad advice. Maybe contact your college and see if they can arrange some kind of refund for not teaching you the fundamentals…

March 25, 2025 at 6:06 ambrother what money minting, it was not an accident ( bus didnt collide or flipped because of animal or some other vehicle , it flipped on empty road due to rash driving,added pics in previous post ) more of a negligence due to which people lost lifes, became handicapped. I could have been a 17 yo orphan and u are saying dont even complaint against them.
