March 27, 2025 at 9:01 amThere a plot we bought around 11-12 years ago. There’s nothing around the plot except brick klins, cricket grounds and farms. Now we’re thinking of reselling the land but when we went there, we got to know that workers of brick klin has demolished the boundary of our land ad has constructed a temporary dart track over it for movement of their trucks. Which made harder for us to navigate from where to where our plot was. Even if make a new boundary they’ll demolish it again. What should we do??? -

March 27, 2025 at 9:08 amHi, lawyer here, based in Delhi.You need to get the land measured and demarcated officially through the local tehsildar or land records office. Once boundaries are confirmed, send a legal notice to the brick kiln owner to remove the encroachment and stop using your land. If they do not comply, file a civil suit for injunction and possession. You can also ask the court to appoint a commissioner to mark boundaries and get a police protection order if needed.

March 27, 2025 at 9:38 amCan i ask you one last thing if you’re a lawyer you might know about it. The plot that I’m talking about. we didn’t know when my father brought this land. But now he got to know that this land is under govt although we have registry and everything in my father’s name but the property dealer guy is convincing my dad to sell for the half price he brought it around 11-12 years ago. Or else you’ll have to wait for the development so that we will get compensation at that time but there’s no chance of any development around that area at least not until after 10 years. My father is adamant for selling it in the loss. What can happen in this situation?-

March 27, 2025 at 9:45 amIf it’s being taken by government then the government will give compensation and it usually is way higher than the market rate. That is the reason property dealer is asking to sell. You can sell it but don’t do it at discount. Negotiate. Also, all the other issues will be solved by government only, so not a problem if you can wait for a few years

March 27, 2025 at 9:19 am1. Ask the kiln owner if he wants to buy your land and more or less simply sell.2. Tell them not to use your property. If he doesn’t follow, File case for trespassing.
