January 20, 2025 at 1:46 pmHi everyone,I’m seeking legal advice regarding an issue I’m facing with a company called Sirphire. Here’s a summary of the situation:
1. I ordered two phone cases (Order No. 757596)—one for Vivo X60 and another for Samsung S23.
2. The case for Vivo X60 is too small and doesn’t fit my phone, making it unusable.
3. I’ve tried contacting the company multiple times via email and WhatsApp, but they haven’t responded to my complaints.
I’m now considering legal action against them. I have the following questions:
1. What is the best way to proceed with suing them?
2. Do I need to send a legal notice before filing a complaint with the consumer court? If so, how should I draft it?
3. What compensation can I claim besides a refund for the defective product?
4. Is there a minimum claim amount required to file a complaint?
I’ve already gathered evidence, including:
The invoice and order details.
Screenshots of my emails and WhatsApp messages.
Photos of the defective product.
Any advice on how to proceed, or if there are alternative solutions, would be greatly appreciated. Thanks in advance!
