January 30, 2025 at 4:01 pmHey everyone,I sold my car in **December 2021** and have a **sale agreement** as proof. Recently, I discovered that the buyer **forged my signature** and fraudulently claimed insurance. They also changed the car model (from Verna 2019 to Verna 2022) while making the claim, these images of newer model is visible in surveyor report. i got the surveyor report VIA RTI and claims details with car number.
i have already informed the insurance company when i saw the car in December 2024. The insurance company isnโt being very helpfulโthey say the signature “looks like mine,” but I never even visited the workshop where the claim was approved. Signatures on claim form definitely varies from my PAN card signature and other official records. the buyer has also used my pan card and aadhar card for this claim, which was attached with car sale agreement. Moreover as per investigator appointed by insurance company, they are saying the these modifications are just cosmetic changes and are legal as per RTO, which i seriously doubt.
Steps Iโve Taken So Far:
โ Informed the insurance company, but theyโre not fully cooperating.
โ Gathered all documents, including the sale agreement.
โ Planning to file a police complaint for forgery and fraud, should I ?
Looking for Advice On:
1. How to prove my signature was forged? Would a forensic signature verification help? If yes what it will cost?
2. Has anyone dealt with a similar insurance fraud case? What worked for you?
3. Should I involve the RTO or take any extra legal steps?
4. Any other precautions to protect myself legally from this fraud?
Note: I seriously doubt that the car model in the surveyor report is different from the one i sold, maybe a stolen vehicle with details of my actual vehicle? as per investigator physical verification of car is not possible as buy is out of India. When car was sold buyer paid Rs 6 lakh (was deposited to my bank account by him) as cash and rest 4 lakh via account transfer.
