        Hello everyone,

        My family is currently facing a legal issue and would appreciate your advice.

        My step mother-in-law filed multiple false cases against my father-in-law, his sister, his brother, and two daughters under IPC sections 498A, 406, 377, 506, 34, and 4 DP Act. Initially, she was not open to negotiation, but after 1.5 years, she agreed to a settlement for ₹15 lakhs. She signed a Memorandum of Understanding (MOU) and also appeared before the magistrate to confirm receipt of the money.

        However, during the high court hearing for FIR quashing, she suddenly changed her stance. She cried in court and claimed she was pressured into signing the MOU and that all her allegations were true. Our lawyer then told the court that in that case she should return the ₹15 lakh and proceed with the criminal cases. She then backtracked and said, “But sir, now it is settled.”

        The judge asked her to file an affidavit explaining why she claimed she was pressured. In the next hearing, she submitted an affidavit saying she was emotional in the last hearing—that’s why she said those things. The judge rejected the affidavit and asked her to consult the public prosecutor and submit a refined one.

        In the following hearing, the same thing happened again. She continues to flip-flop, saying she stands by her allegations, but also says the matter is “settled.” The judge again rejected the affidavit and gave another date. He also asked her: “If you’re saying it’s settled now, does that mean you were lying when you filed the FIR?” to which she responded “No.”

        An important point: this is not the first time. She did the same thing 20 years ago in her first marriage—filed similar charges and then settled.

        We’re stuck in limbo. The FIR hasn’t been quashed yet, and she’s playing both sides. What are our legal options now? How do we proceed in this case? Can this be escalated or is there a way to get some finality?

          This is laughable. The judge should throw the case away since she already signed an MoU. Seems like she wants more money. Your advocate should say that she is harassing and push for trial. In trial they will ask her to produce proofs, and in the absence of proofs, your family will be found innocent. Depending on how the judgement goes, you can go for punitive damages. What a fine piece of “abala nari”.
