February 26, 2025 at 7:54 pmI (23M) recently connected with a seller on OLX regarding a second-hand phone worth ₹60,000. The seller, who introduced himself as a doctor (I believe hippocratic oath is just a myth) from a rural village in Telangana, he seemed genuine. We agreed that I would pay a 50% advance (₹30,000) once he scheduled the delivery since we lived far apart.After receiving the advance, he booked the pickup slot, but the next day, he started delaying the shipment. He claimed he lost his other phone and couldn’t back up his files, which, in hindsight, should have been a red flag—but I didn’t realize it at the time. He then asked me for another ₹10,000 to buy a new phone for backing up his data, and unfortunately, I trusted him blindly.
It has now been over a month, and despite countless calls and WhatsApp messages, he continues to make excuses and repeatedly assures me that he will send the phone “tomorrow.” Although he still responds to messages, he has neither shipped the phone nor returned my money.
In frustration, I even sent him a fake FIR in an attempt to pressure him, but he dismissed it, claiming he knows a local CI who will handle the situation. At this point, I feel completely stuck and unsure of how to proceed. I just want my money back, and this experience has completely shattered my trust in platforms like OLX. If anyone has any advice on recovering my amount, I do, however, have his QR code of his UPI paymenk, full name, and bank details alongside proofs of chat and voice recording of when we had a deal on 26th of Jan.
I would greatly appreciate it for any help in regards to the situation.

February 26, 2025 at 8:08 pmFirst of all please dont blame a platform for your own mistakes since you blindly sent payment when you could have asked him to setup a cash on delivery mail which is fairly easy to do even if you dont have a business.Secondly, what you could have done was flag the UPI within 72 hours as fraud and told your bank to revert the payment which could have done if you had complained within 24 hours.
Now what you CAN do is file an actual FIR of fraud along with a case for monetary recovery against him and complain against him in NMC which is taken very seriously by them and can even cancel his license as a doctor(if he even is one). If you only threaten him he wont pay you anything.

February 27, 2025 at 6:05 amA doctors license will only be cancelled if he is convicted in a criminal case. not when FIR is filed.You can complain only about medical negligence to NMC not that doctor didnt send him phone or any other non medical related.
Sad that you are top 1% commenter giving such wrong information and sending people on wild goose chase wasting their time and effort.

February 27, 2025 at 6:17 amFor your kind info, the agenda is not to get his license suspended, the agenda is to make the doctor get in a vulnerable enough situation to arise at a compromise and give atleast part of the damages incurred by my client. It might seem sad to you probably being an innocent bystander but i know how get justice for my client when it comes to unscrupulous individuals like the one described by the OP.Yes i am a top 1% commenter, but i am also a ruthless lawyer.

February 27, 2025 at 6:23 amSeems like you are fairly knowledgeable about the tactics used by certain unscrupulous individuals on OLX and other second hand sale websites or maybe even a doctor. Or perhaps you might condone the act of the doctor towards the OP or even would like him to “wait patiently” to get his money back.Please dont take my suggestion as an advice to you, if you do not favor it doesnt mean it doesnt work.

Tell me my friend, as a lawyer, if someone files an FIR against you with good evidence in hand of your deception and illegal acts and also files a complaint against you before BCI, wont you be worried you will lose your license to practice if the criminal complaint is allowed?-

February 27, 2025 at 7:47 amSo there is no such thing as a personal criminal complaint against an individual? Kindly read the section about fraud in BNS which the doctor has basically done by promising to send the phone after payment but then refusing to do the same. If it is done by him to more than one individual, it is a scam which again is a criminal act.A single act can be both civil and criminal in nature just like a consumer can ask for civil recovery of high interest taken from a bank but can also file a consumer complaint. But can run simultaneously. In fact many a times criminal complaints are dismissed but the civil recovery suits succeed. That way even if the person is not jailed, he still has to pay in civil liability which if he doesnt pay can still be jailed.
This all we learn in practice cos our theoretical knowledge cant provide justice to an individual as it encourages to use one tactic or the other.

Perception changes from various points of perspective. You are debating from the doctor’s perspective I on the other hand am looking from the OP’s perspective who made the post.

The guy probably isn’t a real doctor. They have better things to do. OP can bribe the local police to file a real FIR. The doctor can file a case against OP for forging a government document. OP is cooked either way. -

I always thought that you pay through the platform, and it is only disbursed to the seller when the product is marked received. Is that not the case anymore?

You have to click ok on it to proceed to chat. If that is done and if you havent paid via the platform like you do in amazon or ebay, they cant be held liable.

February 26, 2025 at 8:19 pmTitle is extremely misleading. I though this was some case of a doctor taking money and not treating you/overcharging you.It’s in fact a simple scam. You say that you lost trust in OLX, but you should understand that it’s your stupidity that has led to this situation. Now file a proper FIR, report to OLX etc and introspect on being smarter.

Deal happens when both parties have some stake in it if one loses the other will also feel the heat and here you are the finest example of….. Well you understand.

February 27, 2025 at 3:04 amWhat phone was it? Has to be a very high end phone which was advertised as selling for cheap.Anyway, firstly, a very misleading title. Secondly, by preparing a fake FIR you have committed a cognizable offence under BNS. If it ever comes to light you may do some jail time and at the least spend 10 times the money you have sent to make the case against you go away.
If you would not have made the fake FIR, I would have suggested filing an FIR for cheating, but for 30k it’s not worth it TBH.
So just forget about it. Let this be a life lesson to you.
