March 15, 2025 at 7:06 amYesterday evening, my friends and I were sitting at a train station, smoking cigarettes. The police caught us and took us to the station, where the officer suggested putting fake charges on us just for smoking. My friend got agitated, started arguing with the police, and even used the word “lund” towards the Sub Inspector. That was a big mistake.The police then took us to a room, slapped both of us hard multiple times, and caused a lot of physical discomfort. They called our parents, took our Aadhar and voter cards, filled out a Challan, and told us to go to court on Monday. The police have filed three complaints against us: one for smoking in public, one for abusing the police, and one for being in the railway station without a ticket.
I need to know: are our names now recorded at the police station, and are we considered criminals?
I’ve never faced this kind of harassment in my life.
My mom said she will go with me to the court on Monday, I don’t know the process.

Yes, since a challan was issued, your details are now in the system. However, this does not mean you have a criminal record. Challans for minor offenses do not automatically make you a criminal unless convicted in court.
2. What happens in court on Monday?
Since it is a challan case, you will likely have to appear before a magistrate, where the charges (smoking in public, abusing a police officer, and trespassing in a railway station) will be read out.
In many cases, courts impose a fine, and once you pay, the case is closed. However, the “abusing the police” charge might complicate things, depending on how they framed it.
3. Should you hire a lawyer?
If it is just a matter of paying a fine, you might not need one.

March 15, 2025 at 7:41 amThe police did the right thing. Smoking in public area is offense and top of that your friend also abused the police. If you don’t have any good connections of local MLA or lawyer then you are pretty fucked up. Good luck with courts.-

Thatโs amusing. Your best course of action is to appear before the magistrate on Monday, genuinely remorseful, and make it clear that you regret your actions. Explain that a conviction could seriously impact your future.
But let me be clearโif you or your mother try to argue, act entitled, or attempt to strong-arm the magistrate, you will only make things worse. A conviction for abusing the police (depending on the charges filed) isnโt something that just disappears; it will stay on record and follow you forever.

March 15, 2025 at 8:05 amWhile police have charged you with relevant sections, talk to a lawyer to figure out the way further, and also check if there is any legal recourse for the physical/mental abuse you experienced (but doubt if that’s gonna be worth all the trouble). -
