UHi everyone,
I am looking for legal advice and possibly a lawyer who handles insurance mis selling or consumer cases in India. I am ready to pay professional legal charges if someone experienced can guide or represent me.
Here is my situation:
I purchased a term insurance policy from Bajaj Life Insurance through an offline agent. During purchase, I clearly asked for a Critical Illness rider covering 60 illnesses. Since the proposal form did not mention the number of illnesses, I specifically asked the agent to share the list of covered illnesses. She shared the list of 60 illnesses and confirmed that my policy would include the same.
I have screenshots and call recordings where:
– I clearly asked for 60 illnesses
– The agent acknowledged and confirmed it
After medical tests and underwriting, the policy was issued. When I carefully checked the policy bond, I found that only 10 illnesses were included instead of 60. The policy itself shows options for 10, 25 and 60 illnesses.
No change was communicated to me and no consent was taken.
When I complained, Bajaj rejected my complaint saying I signed the proposal form. But the proposal form itself does not mention the number of illnesses under the rider.
Now they are offering cancellation and refunding only Rs 23204 against the premium amount of Rs 28065, deducting around Rs 4861 towards medical and other charges.
My point is simple:
Why should I bear any financial loss for mis selling done by their own agent?
I believe this is:
– Mis selling
– Misrepresentation
– Deficiency in service
– Unfair trade practice
I have:
– Proposal form
– Policy bond
– WhatsApp chats
– Screenshots
– Call recordings
– Complaint emails
I have already approached IRDAI and Ombudsman, but I am now looking for proper legal guidance and possibly filing a consumer case.
