May 6, 2026 at 2:38 pmHi everyone,I recently discovered that an Indian brand, Max, has used a photo I posted on my personal Instagram account in one of their ads on Instagram. I did not give them permission to use my photo, and it appears to be a commercial use of my content. Someone close to me spotted it.
I know privacy laws are a joke in India but what options do I have?
Iβm based in India, and Iβm looking for advice on the following:
1. What legal options do I have under Indian law for unauthorized use of my photo?
2. Can I demand compensation, and if so, how is it typically calculated?
3. Should I first contact the brand directly, or consult someone before taking any action?
I want to make sure I handle this properly and understand my rights. Any guidance or references to relevant laws would be greatly appreciated.

May 6, 2026 at 2:53 pmSend them a legal notice demanding compensation and if they donβt comply file a suit.. you can claim any compensation as you may deem fit.. if the matter goes to court.. the court decides the amount of compensation you will get -

First send a legal notice to Max Fashion asking them to remove the ad and compensate you. You can claim compensation for unauthorized commercial use. Amount depends on reach, usage, and impact. feel free to message me if u need help

May 6, 2026 at 4:47 pmthis kind of thing feels really violating especially when a personal photo suddenly turns up in a commercial ad without even informing you the part that usually matters most in situations like this is being able to clearly show that the image came from your account and was used commercially by the brand because that changes it from casual reposting into something bigger also brands sometimes quietly remove such ads once contacted so how you approach first contact can shape what happens next have you already saved screenshots and links showing the ad running along with your original instagram post in case they take it down later
