Need Legal Assistance for my bank account freeze by Cybercrime cell

so i m a student and do Meesho reseller and kind off drop shipping, and i sold some product to some people in April but from the text and other stuff they misinterpreted it and took me as scam and filed a cybercrime complaint against me

and cybercrime cell put 3 lien on my account from 3 different police station- Delhi, Bengaluru, Bengaluru

after my account was frozen i reached out to the buyer and sorted everything and even returned then there money and asked them to withdrew the complaint which they did

and i mailed and called to these police stations the same

the thing is my bank(HDFC) wont unfreeze my account without NOC(no objection certificate) from respected police station

after multiple times calling the police they don’t pick the call one police station police picked the call i explained them the whole situation and said i m a student i cant visit the police station cause i live far away he said you will need court order for NOC we cant provide without it

and i m a student and i live very far from the cities the case is filed from and don’t know what to do i cant afford the fees of a lawyer and asked for money from my friends to give them to the ppl who filed the complain and now they are asking me for money its been over a month and my account is still froze i cant tell things at my home cause our financial condition is not good and i have even tried for National Legal Service Authority(NALSA) legal aid but they said for NOC NALSA wont be helpful and should rather hire a lawyer i don’t know what to do, i have all the proofs and also no objection in written from the people who filled complaint still i m unable to get any thing done

can anyone help in unfreezing the account or guide what can be done to get NOC as soon as possible cause i have no other account and facing major issues cause of the lien

Tried this the bank denied and said there is no such process and I have to give noc

Write an application quoting that you need the grievance addressed as per the SOP issued by the MHA. If they fail to do it, forward it to the SP.

If nothing works, you’ll have to file a writ petition before the High Court.

Did you give it in writing? If yes, then forward the application to the Superintendent of Police, stating tht the bank is refusing to follow procedure, you can also mail the application and the refusal to the bank HQ.

What amount is frozen? The entire SA can’t be frozen.

I’m not a lawyer but I have fantastic experience self-representing myself with complex arbitration, securities, torts and so on.

If you want me to, I can help you out for free. Draft the documents you’ll need including BSA 63 etc, you just need to register online for efilling of court documents, ask for exparte adinterim order for unfreezing of assets and make it clear in the petition that you don’t want to make any oral arguments and the court should rely on written submissions you have made.

First hearing – 1 or 2 days post filling of civil claim.

On the side note, I would also suggest that you sue those buyers for abuse of process and seek civil remedies for the same – you can include these claims in the same suit + it will cost them money to defend it.

Important: You can attend entire proceedings online.

Note: NALSA is supposed to help you if you qualify and you have a good prima facie claim (which I believe you may). They are just being lazy.
