May 1, 2025 at 6:48 amHello everyone,I’m in urgent need of legal advice regarding a broker who has taken my rent and security deposit but has neither given it to the landlord nor returned it to me.
Summary of Issue:
A broker took ₹13,500 from me — ₹9,000 as rent and ₹4,500 as half the security deposit. Out of this, he gave only ₹3,000 to the landlord (which covers just 10 days’ rent) and only after I pressured him repeatedly. He is now refusing to return the remaining ₹10,500 and even said I can “do whatever I want” — but he won’t give the money back.Key Points:
• On my first visit to the flat on
18/04/2025, he falsely claimed to be the landlord’s relative.
• The ad claimed to be posted by the owner, but he turned out to be a broker.
• He never disclosed that he was a broker or that a commission was involved until 20/04/2025, the day I was shifting in.
• I refused to pay any brokerage as it was never mentioned earlier.
• He took ₹13,500 from me (₹2,000 token on the first visit + ₹11,500 on shifting day), promising to transfer it to the landlord — but hasn’t done so.
• Promised me a fridge and RO purifier before shifting in, which were never provided. Now he denies ever promising them.
• After my first visit, he told the landlord that I didn’t want the fridge or RO — which I never said.
• He also lied about 300 units of free electricity per month, which the landlord later denied.
• He gave both me and the landlord false and contradictory information to manipulate the situation.Timeline:
• 18/04/2025: First visit, paid ₹2,000 token money.
• 20/04/2025: Shifted in, paid ₹11,500.
• 21–22/04/2025: Confirmed broker was lying about his relation to landlord, promises, appliances, etc.
• 29/04/2025: No refund, no appliances, broker is refusing to cooperate.What I Need Help With:
• Can I file a police complaint (FIR) under fraud or breach of trust?
• Should I go to consumer court or file a case under the IPC?
• What section of law can I use for this kind of cheating?I have all payment proofs. Any help or direction would be deeply appreciated.
