April 18, 2025 at 9:26 am**Hello everyone,**I’m seeking legal advice regarding a challenging situation involving my Syrian girlfriend, who has been residing in India for over five years. She initially came here to pursue her BTech and is currently completing her MTech. Her student visa is set to expire in June 2025.
The main concern is that renewing her visa requires her to return to Syriaโa move that poses serious risks to her safety due to:
* Ongoing instability and violence in Syria
* The possibility that she may not be permitted to return to India once she leaves
* Her belonging to a minority community, which makes her particularly vulnerable both in Syria.This situation is causing her considerable emotional distress. We are in a committed relationship, and I am fully prepared to take responsibility for her safety and well-being here in India. While we do intend to get married in the future, certain personal and family circumstances prevent us from doing so immediately.
Any guidance or support on how to navigate this legal and immigration issue would be deeply appreciated

April 18, 2025 at 9:33 amnot a lawyer (law graduate tho) and not a legal opinion but if your affection towards your partner is really something, than try to convince your folks, if necessary fight for it. I can understand how precarious situation would be for her if she is compelled to return back in golani’s banana republic. I am pretty sure you know how dire situation is there, especially now. You can provide her legal asylum, another shot at life. even if your affections fall short soon after marriage (I hope not) she could still be in a stable environment to continue make an attempt at ‘life’. -

Can’t she book a return flight on the same day and land there, get the stamp on the passport and stay in the airport or a hotel nearby and then return on the same day or next day? I am not sure if just landing there itself too risky…in that case this may not be a good idea….-

Can the Syrian embassy in Jordan itself might be able to stamp the passport? just a guess …

April 21, 2025 at 4:25 amYouโre right. I do have a well-paid job thatโs more than enough for both of us, but jumping into marriage right now just feels off. Itโs not that Iโm against itโitโs just not the right solution for the situation at hand. Maybe we could consider it as a last resort, but ideally, weโd prefer something else that makes more sense legally and emotionally. Sheโs also really talented and earns her own pocket money through Instagram and some other influencing work, so itโs not like sheโs entirely dependent either.-

But only issue here is she has her immigration entry with officials.

April 18, 2025 at 5:29 pmhi, id highly recommend you to get in touch with ngos that deal with asylum. syrian women doing masters in another country would qualify. i would also recommend getting in touch with funding ngos if she needs funding. iโll not share names publicly for safety reasons.id also like to speculate, given the fact that she is muslim, and a refugee, it would be difficult to get her asylum in india. but if any European country takes her, the visa issue will be solved without any risk to her.
do talk with an immigration lawyer. ngos also often provide lawyers with experiences like this. especially international ones. but shopping around for immigration lawyers would be a good investment.

April 19, 2025 at 4:17 amI think you may have misread his post, he said she will face problems there because she belongs to a minority community (and not a muslim). In Syria, the minorities are Christians, Druzes, Jews etc .. they are treated badly there…no safety for them.

Go there complete the visa process and fly back. Asylum is not the good idea it has its own complication in a way that she can’t go to syria or neighbouring countries even everything become stable there.-

April 21, 2025 at 10:49 am1. Send a notice to relevant government agencies who regulate the Visa and stay of foreign citizens in India.
2. In the notice cite all your concerns and plead them to extend her Visa under these extraordinary circumstances by implementing principles of Natural Justice.
3. If they don’t agree or faip to reply, file a Writ Petition in your state’s High Court immediately under Art 226 and Art 21 of the Constitution.
4. The High Courts will be much more empathetic and your gf may get her Visa extended.
5. Show relevant character record of your gf and the threat to her life if she goes back to Syria.Let me know what happens.
