April 25, 2026 at 8:34 amI need legal advice regarding noise pollution caused by a newly established religious place in my locality.A family in my neighborhood recently (about one month ago) inaugurated what they are calling a Radha Krishna โashramโ on the lawn of their house in a residential area in a village in West Bengal, India.
Since then, they have been playing very loud devotional music through speakers early in the morning around dawn, again in the evening, and now sometimes at noon as well. They usually play music for around 1 hour at dawn and another 1 hour or more in the evening. There is also loud live singing during these times.
This has started affecting my daily life significantly. The early morning noise is disturbing my sleep, and the evening noise is making it difficult for me to study and concentrate at home. I am currently preparing for government exams.
I have already tried to resolve the matter politely by speaking to them directly and requesting that they lower the volume, but they do not seem to care and have continued doing it.
From what I understand, loudspeaker use before 6 AM may violate the Noise Pollution (Regulation and Control) Rules, 2000, and excessive noise in a residential area may also be illegal during the day.
I want to know:
1. Whom should I officially complain to firstโlocal police or the West Bengal Pollution Control Board?
2. Is filing an online complaint effective in such cases?
3. If the place is a private residence converted into a temple/ashram-like place, does that change anything legally?
4. I am concerned that complaints may be ignored due to local influence or bribery. How can I make sure the complaint is taken seriously?
5. Would recording audio/video evidence help?For context, I am not against Hinduism or religious practiceโI pray to Radha Krishna myself. My issue is only with the excessive noise and the disturbance it is causing. I have spoken to some local people, and they are also facing similar problems, but they are hesitant to complain.
Any legal or practical advice from people who have dealt with similar situations in India would be appreciated.
