UI stay at an apartment complex and from one of our room windows, we have a view into the balcony of our neighbour who lives one floor below us.
Now on multiple occasions, I have seen this man walking around in only underwear, and also completely nude. I brushed it off thinking “it is his house, he has a right to do what he wants”.
However, today while looking out of my window, I caught him engaging in sexual intercourse with his partner (both nude of course). That to me, crosses the line.
Maybe they thought we couldn’t see into their balcony, but this must count as public indecency/ indecent exposure surely?
I just want to know if anything will come out of pressing charges against him? Should I at least file a complaint to somebody?
Any advice would be highly appreciated as I cannot have this happen again.
TLDR : caught my neighbour one floor below having sex in his balcony. Want to know if it counts as indecent exposure under the Indian Law?

UI don’t know about you, but I would feel very uncomfortable if I had guests over and one of them (God forbid, a child) saw this through my window.
It’s wrong, and he could be doing this anywhere else in his house, just not somewhere that other people have a view of.

UHi I completely agree with you, it’s just that I’d feel uncomfortable if a guest or possible a child saw this, it doesn’t sit right with me you know?
All I wanted to know is if there’s anything I can do about it or not.

UDo you have curtains ? You can try telling them directly if it happens again or really frequently but i don’t think that would be the case. So I suggest just getting curtains or keeping the balcony locked when kids come, guests even if they see it will ignore it cause it’s awkward. You could tell them nicely tho, that’s the only way, complaining etc would be too much and hinder them from having freedom in their own house

UActualy You might be in trouble under Voyerism Laws (354C) because you watched his GF ( female ) in place were privacy is ” Expected ”
Now there many small things in this law but It’s definitely a twistable law.

UWell, you’re kinda having a war in the comments lmao. I understand not everyone likes a free sex livestream. Next time maybe just try to make some noise when they’re at it to let them know that others can see them. if that doesn’t work try filing a complaint with the society or police. That should help.

UHow about just leaving them alone? Why is your first instinct to go tell somebody? They’re happy and are likely into exhibition but they’re doing it INSIDE their property and not bothering anybody. Do the same and mind your own business. It’s not like they do it everyday (as per your description), it won’t do you any harm to look away from the window once in a while.
There’s already enough hate going around, please don’t add to it.

VIf you really want legal action, you’ll have to prove:
1.That their balcony is clearly visible to the public (not just your peeping eyes).
2. That multiple people (not just you) were offended by it.
3.That you didn’t actively choose to keep watching.
If you can’t prove this then you are the creepy one and should be booked under voyeurism.

ULol I have the same problem but with my upstairs neighbour. Though i cant see them but they are very loud! And this thing usually happens around 2 am in the night so most other immediate neighbours would be unaware i guess. I don’t like it but don’t think there’s much i can do here

Mwhy don’t you guys ever try talking to people… you don’t even have to be specific, just say you were getting disturbed in the middle of the night by noises, most people are decent only and will understand what the issue is
