I work in a consulting firm where the notice period is 3 months. However, as the practice goes, employees are released before 3 months if they are serving NP and don’t have projects in hand.
Recently, there has been a resignation spree from my team which has led the management to become nervous about resourcing for upcoming projects and are not flexible with letting people go before their 3 months is up. They are not even considering NP buyouts saying that it is subject to management discretion.
I am serving my NP for about a month now but my future company wants me to join by mid-April. I am negotiating hard with both sides (current and next companies) but none of them seem to be moving. I can just leave my laptop on my desk one day and leave but I dont wanna burn all bridges like that.
My offer letter says that early exit and agreeing for buyout is based on management discretion but AFAIK these terms aren’t legal. What is the legal process that I should follow to make my employer agree for pay in lieu of notice?
