March 24, 2025 at 12:44 amI am an NRI visiting India for 2 weeks. I was injured in car accident last week. Undergoing medical evaluation. The cab I was riding in is not at fault.
The accident site is 4 hours drive away from my place of stay and police did not come to take statement when I was in the area being checked up at a hospital where ambulance took me, despite being asked by ambulance folks to do that.I am being asked to sign and submit a No object certificate to pursue no future legal action to be sent with my cab company representative in 2 hours. I am not comfortable and do not know laws of India. Hence seeking help here. The offender is also a car company.
1. What if I donβt sign NoC? Does it have any implications on my current stay or future travel to India?
2. Police insists on coming in person if I want to file any claim or give statements. Can this be done online?
3. I want to take my time to understand my rights and total cost of medical treatment, wage loss, once I return to my home country. I also Need to change travel itinerary leading to additional cost. Who is liable to cover my cost?
4. which costs cannot be covered?
5. Police asking for NoC in local language but I am an English speaker so prefer that language? Can they force me to their choice of language?
6. Can my embassy help me in this process to navigate path forward and protect my interests?
7. Who is responsible for filing FIR? I need its copy.
I hope to travel back in 4-5 weeks after recuperating.
