April 27, 2025 at 10:35 amSomeone I know is a Group-C employee, as an FDA in a state government department. She’s an excellent employee, having gotten good reviews from her seniors in the past five years.However, in the past two years, lack of recruitment as well as ongoing retirements has meant that additional charges just get dumped on her. She has taken on multiple additional charges within her department already, and is not getting paid charge allowance. Now she’s being told to take up a Group-B role as well, something from a whole different section of her office. She voiced her concerns, but she’s being kind of coerced to accept the charge.
My question is, can she accept the charge under protest as a Group-C employee? She asked about this, and was told that it’s only possible for Group-A employees and the like.
Also, what are her other remedies here? What’s the legal recourse here, and what kind of lawyer should she approach? We were told that she might have a chance with the labour court, but are confused how to go about it.

April 27, 2025 at 10:47 amThere is a provision in the employment rules which is read as “equal work, equal pay” Use that. The world is like that the more you tolerate the more you will be bullied. Stand up.-

April 27, 2025 at 10:54 amIsn’t this for equal wages for male and female workers? Her issue currently is that she’s the junior most employee still, even though she has almost 6 years of service. So every time a retirement happens, the charge goes to her. Ideally new recruitments should happen, but they haven’t. Or charge allowance should be given to her, but she’s being discouraged from applying for it, saying there’s no guarantee it’ll be passed by their head office. Can she send legal notices for this?-

You mentioned in your original comment that she is a government employee (Group C).

First, she needs to apply, in order to know the outcome. If rejected, then only you can appeal/approach Central Appellate Tribunal.

Equal Work, Equal pay is a universal human rights. India is a signatory to this. It goes without saying that it applies to both central & state government employees. Read the Rules. There is a provision. Since no information is shared regarding the person, therefore I cannot provide you the specifics.-

April 27, 2025 at 9:32 pmI was asking what equal pay, equal work principle was in relation to. Not a lawyer, so have to rely on google ๐คท๐ปโโ๏ธShe’s still the junior most cos no one has been appointed to her office after her. Everyone else has decades of service.
Have been telling her to apply for the allowances. So will see what happens after that. Thank you for taking the time to respond.
