February 25, 2025 at 2:01 pmSo i finalized a small 1 room set in panipat haryana and the owner demanded security deposit of 1 month on the spot of 10k to finalize it.. didn’t seem like a fraud guy and since he was agreeing to make rent agreement in the next week i thought what could go wrong..now before moving in, he is placing restrictions on who can visit you (no girls i had agreed to but he says no friend even for a minute will be allowed) which are impractical and when i said cancel the deal and give me money back says you are the one backing out u won’t get any money..i have all the call recordings with him and all voice recordings of me meeting him and seeing the property…What to do?

February 25, 2025 at 2:17 pmHe’s changing the rules after taking your money. That’s not fair. Since you have recordings, tell him firmly you’ll take legal action if he doesn’t return the deposit. If he still refuses? File a police complaint or take it to the consumer court. Most landlords back off when they realize you’re serious.-

February 25, 2025 at 2:25 pmI did have a very hot talk with him warning of all actions..not budging..now I’m thinking how to proceed..if i file a police complaint i don’t think the police will do anything or am i wrong?
And is it consumer court matter or civil court or criminal court? I thought consumer court applies only when we buy something..-

February 25, 2025 at 2:31 pmYou’re right i guess, consumer court is for product/services disputes, so this is a civil matter. The police might help if you frame it as fraud or breach of trust, but for real action, you’d need to file a case in civil court.

I wish if there was a third party lock-in wallet to put the money as deal-in-progress until committed. if anything goes wrong the party can claim it back without the fear of falling to idiots.-

February 25, 2025 at 8:40 pmWhat kind of advice is that? My shifting expenses will be more than 10k plus hassle and he won’t let me stay without paying 1 month rent upfront..and since I’ve had an altercation with him won’t be such a nice experience staying there anyways

February 26, 2025 at 1:31 amPaying without signing an agreement was a mistake. Non the less, police filing and hiring a lawyer will cost you more than recovering that deposit. Consider that amount lost. Move on and don’t make mistakes like these again.-

February 26, 2025 at 9:10 amIf you had a rent agreement you had a valid contract. How do people not understand that. Right now you have just given him money on trust and he has broken that trust. What are the lawyers and police going to do about that. There is no paper trail of the amount but that UPI transaction. How are u gonna prove.-

February 26, 2025 at 10:06 amBhai nothing is going to happen with that. What is the proof any of those recordings belong to the landlord? You will have to pay under the table to cops and lawyers which will be more than 10k. Let it go or speak to the landlord and tell him the deposit was provided basis rental space. If you’re not occupying space, he has to give that back.-

February 26, 2025 at 10:40 amThen unfortunately that money is gone man. Try your hand with cops, if it works it works, otherwise just ask a lawyer to draft a notice. I don’t see anything else happening.
