February 17, 2025 at 5:49 pmHi needed a small legal advice regarding a property dispute which will happen soon.My grandfather (hindu by religion) owns 24 cents of land. He has one wife (my grandmother) and two daughters ( my mother and my aunt). My grandfather passed away in 2016 and he has not kept any death will. My grandmother is staying with us and we were the ones( myself and my mother) who have been looking after her whole life even before my grandfathers death. My mother and aunt came to decision to sell the land recently. But my greedy aunts wants a 50-50 partition. My grandmother told we would do a 35-35-30 (35% for each daughters and 30% for grandmother) and the daughter who looks after her will keep her share after her death, which will be my family since we were the ones who have been looking after her. On hearing this, my greedy and wicked aunt has said she doesnt want to sell the want now. She wants to wait till my grandmother passes away. I want to know the following legal side:-
1. Who has right for property of my grandmother? My grandmother or daughter?
2. Can we sell the property without her consent?
3. If you were in such a situation, what would be your move?Thanks in advance!
