UI need legal advice regarding a family-owned property in Madhya Pradesh. The property currently consists of:
Ground floor – owned by my Father
First floor – owned by my Tauji (Father’s brother) (He is no more and it is on the name of his 2 sons and mother)
Common area and terrace – Equally divided
We now wish to divide the property vertically, so that both can sell our portions separately.
Key Questions:
1. Since the original deed divided the property by floors, can we now execute a Partition Deed to legally split the land?
2. Would an Exchange Deed be a better option in this case? If so, how would the common areas (like shared walls or access points) be handled?
3. Will Chacha Bhatije is considered as blood relatives?
4. What approvals or formalities are required for a vertical division of the land?
5. Additionally, we would require assistance in drafting and registering the necessary legal documents.
