February 3, 2025 at 1:36 pmHi,I was involved in a car accident where the person in front me applied brakes which caused me to crash into his car. He had applied sudden brakes on the highway and I had also applied brakes following that but obviously my car didn’t stop in time. Thankfully no one was hurt. Today he called me saying that I have to pay for damages. I said this is not my fault since applying breaks in the middle of highway will cause an accident. He said he’ll then have to file an FIR. What should I do?
PS: I have a video recording from the guys in front of his car, who were stopped on the side of the road claiming it was that guy’s fault and he was not paying attention

February 3, 2025 at 8:57 pmThis is it OP. Either you’ll have to pay for damages or other person will claim insurance, which includes FIR. It doesn’t matter if you have the video. If you rammed into someone you’ll be at fault because you are supposed to maintain distance in highway.

February 3, 2025 at 2:02 pm*but obviously my car didn’t stop in time*– that is because you were driving closer than the recommended driving distance which is half of your current speed. Also damage should be paid by your insurance, thats what insurance is for.

February 3, 2025 at 3:53 pmThumb rule if you have banged him from the back – you will be regarded as not having maintained adequate distance – and therefore responsible.Consult a traffic policeman for a quick opinion.
You may want to resolve this via your insurance company – but this may need a FIR – for the person in front to get paid. The case might take 2-3 years to close.
