BContext: My uncle was running a guest house on lease in Gurugram. Post the second wave in 2020, my uncle couldn’t pay much attention to the guest house due to aunt’s condition during covid.
During that time apparently there was a raid by the police where they found a guy from Sudan living in the guest house with an expired Visa. BTW we had a lot of foreign nationals living in the guest house. FIR was filed against my uncle under Foreigner Act, 1946 Section 14.. From what we know, the guy was here to visit a friend and the guy was studying in Bangalore and he did not intend to stay. Police apparently says that their informant reported about this guy living at the guest house illegally but it’s all BS and made up.
Few months prior to the incident, my uncle refused to pay hafta or bribe to the local police chowki. The ASI in the police station asked my uncle for a new printer for office and sent him the model number on WhatsApp. But my uncle again refused to pay hafta/bribe. My uncle thinks that this could be the reason Police did this wantedly.
Moving on to 2025, all my uncle gets is tareekh pe tareekh and the case hasn’t even moved to argument stage in 5 years.
How can we close/expedite the process? Any help is appreciated. Jai Hind 🙏🏼

SWho is your lawyer? Why did your uncle pay 7k instead of to the lawyer? Why not file a WP in the High Court?

BInitially it was a good lawyer we hired from a recommendation. He is an ex-BAR president. But since the case is a petty one, he gave it to a guy under him.

LDid you uncle follow all processes , procedures and due diligence for every resident at the guest house ?
