        Hello!

        I have an Old house which belong to my Grandfather who passed away jn 2011 and my grandmother expired in 2018. My grandfather had 3 daughters and 1 son my father who passed away in 1995.

        Thereafter I executed a Relinquishment Deed where all the legal heirs presented themselves and relinquished their share in my name in year 2020.

        Now one of my bua passed away in 2024 so her daughter had field a legal suit against me claiming share in property and has raised property by claiming share in property at valuation of 70 lakh.

        I My question is should I sell disputed land as there is no stay on the property as of now and the judge is not able to understand the ill drafted petition filed by my cousin sister.

        My question to all lawyers here is that is my cousin sister even entitled to get relief by such petition bcoz her mother had already relinquished her share through a registered relinquishment deed in 2020 and had even passed away. She is also claiming that I made her mother execute deed under force or pressure.

        This is enough mental harassment for me so please tell should I continue legal battle as I m confused bcoz it is a thing of ego and family reputation since it is our ancestral house and I grow up in that house!

        Or should I sell this land as there is no stay as of now and in future she may get it since our courts are based on money and power these days.

        What should I do ??? You can share some case study in this matter or court rulings !!!

          The settlement deed executed by their predecessor (her mother) is completely binding and would act as a complete estoppel to any further proceedings on the same subject matter (estate of grandparents).

              What if she try to prove it was executed under pressure or force or wrong influence???
