So as title, we had bought TVS Iqube E-scooter from the showroom from Nagarbhavi, Bengaluru on July 2022, my father is physically challenged (Polio), so we had attached side wheels to the vehicle for the balancing (with the showroom permission as well as RTO)….after an accident we had to get the sid wheel removed as it was completely destroyed (Only side wheel, the vehicle was untouched). Currently, I am using it since then, as I got my DL, (19 M) ofcourse without the side wheel…

The problem is that since the purchase every 3 months we had gone to them and complained about the mileage, they claimed 105km (Eco mode) per charge by the company, we had no where close to it. We used to get the mileage around 60 to 65 km per charge in only eco mode. They complained saying it’s due to the attached sidewheels. So we stood quite saying may be, even though we couldn’t believe saying that was the reason. Now, even after the detachment of the side wheels, I used to get 70km per charge. Slowly it fell to 55km per charge, again only eco mode. We gave it multiple times complaining about it, they used to keep it for a whole week and give it back with literally almost NiL changes. Nothing would have been improved. One time, we had given it and they kept it with them for a whole **3 weeks time**. Yet, they didn’t improve anything…this has been repeating for 3 whole years. Earlier this month it had stopped in middle of the road itself, it didn’t turn on, the whole time, I was 12 km away from the centre (as well as my home). I had to push it myself till the showroom while keeping my mid sem exam the following day. They kept it for a week again, concluded saying the battery is to be replaced. (Forgot to mention this, they did replace the battery when they took for service for 3 weeks and don’t know why, they replaced back to the old one). Upon that I had to pay the replacement charges (~400rs) and they changed this time for free of cost, as it was under warranty. Today again, I had another midsem exam, the vehicle didn’t start again with a caution warning with sound and there was 15% decrement in charge over the night for nothing. With no choice I had to take my dad’s car. Later went and dropped the vehicle in hurry, (had a close occasion in my cousins house). They are saying the other battery is now to be replaced as well. (The vehicle has two (bi) battery.) They have to replace the 2nd one, they claimed now, the new batteries don’t have warranty and after 3 months if any battery fails we have to pay them 30,000 for each battery along with their extra charges like labour, etc. And literally, there is no improvement in the mileage still in 60km per charge, after 3 months we have to pay for everything even for mileage test and issue….like see we bought it for to save fuel costs. But these people literally had it with themselves ½ of the time.

So, I am thinking to file a consumer case on them ASAP, so that they take it seriously and either I get compensated with all those my fuel, taxi costs, time as well and extend the warranty….or they replace the whole vehicle with a new one….I am new to these, so please guide me how to proceed and file a case and also how to prepare as well…..would be really grateful to each one of you here…..

You appear to have a strong case under the Consumer Protection Act, 2019, due to persistent service deficiencies, potential product defects, misleading mileage claims, and the ongoing inconvenience caused to your family—particularly considering your father’s disability and your academic responsibilities.

To proceed, first compile all relevant evidence such as the purchase invoice, warranty card, service records, photos/videos of dashboard warnings, and proof of communications with the service center. Document the impact this issue has had on your daily life, including any expenses and missed obligations.

Next, consider sending a legal notice to the showroom and TVS Motors, outlining the timeline of issues and demanding resolution (such as a replacement, refund, warranty extension, or compensation), while warning that you’ll file a consumer case if they fail to respond within 15 days.

If they do not resolve it, you can file a complaint online at https://edaakhil.nic.in or offline with the District Consumer Disputes Redressal Commission in Bengaluru. In your complaint, include your details, a summary of the issue, list of evidence, and clearly state your demands. You can claim remedies like replacement, warranty extension, compensation (e.g., ₹50,000), and litigation costs.

Ensure all further communication is in writing, and if any documents are in Kannada, provide a brief English translation.

Thank you soo much, but unfortunately my father doesn’t have any phone calls recorded but we do have complete history of the phone calls and duration of the calls with the centre….and regarding the history with the service, we had specifically mentioned only about mileage so many times, but they did responded and said they noted it down, but when I asked them to give the service history of the vehicle they haven’t mentioned it anywhere about it…when asked about it, they said speak to the respective person in-charge who noted it down, while those people aren’t there anymore working in this centre….

You’re very welcome—and thank you for sharing these additional details. While the lack of written records or call recordings makes things a little more challenging, you still have a valid and reasonable complaint, especially given the service logs, call duration records, and your repeated efforts.

**1. Call Records Can Still Support You**

Even if you don’t have recordings, your mobile call log (duration, date, time, number) can serve as circumstantial proof that you were in regular contact with the service center. You can:

Take screenshots or download a detailed call log from your mobile service provider.

                      **2. Missing Service History Entries**

Their failure to note mileage complaints in the official job cards or service logs is itself a deficiency in service. If check for:

Screenshots or receipts showing dates you gave the vehicle for service.

You definitely have a case and should consult a professional lawyer. You can ask be any doubts or questions and I’ll try my best to answer.

                      Best of luck.
