        Is the judgement too harsh? I have seen many getting bail when female partner was 17.5 plus years why not in this case then?

            Most men who get bail mostly when the woman is above 17 but below 18, and the man is just 18. The age difference here is more than 5 years. There is a huge mental maturity difference between the two.

            The court did the right thing. And also, any marriage where either party is a minor, the marriage is automatically void.

                That means the law is subjective right? It doesn’t follow minimum age of 18 in every case ?

                      Depends from case to case, upon every judge. The judge decides on his own discretion. Judges don’t always follow the law. They do what they feel is right. Even if it means enforcing their beliefs on the parties.

                      There should be little to no room for interpretation in Pocso laws.

                          This is a very shitty decision imo. Pocso should not have this much room for interpretation.

                                  The court has the power to grant bail in non bailable offenses but at its own discretion. It is not a right.
