March 20, 2025 at 11:31 amMy grandfather had a home. He had 3 sons and 2 daughters.Naming (name changed – from elder to younger): Sanjay, Akshay, Ayush, Akshita, Rohini.
Grand father: Dinesh
Now, let’s suppose that Sanjay got married and within 7 days of his marriage, he left home with his wife. He gave a written statement that his “hisaab kitaab” is done and there are few pictures of his stuff getting loaded in a truck. He got money from his father and he is leaving. Now, after Dinesh’s demise of 6 months, Sanjay puts a court case that he wants 3rd share of this land.
It has been over 20 years that this case was in court. Now my father has unfortunately passed away. What can be done next?
I don’t know where this case will go, and what will happen.
Can anyone guide on this?
One time this Sanjay uncle had expressed that he wants INR 15 lacs to take back this case. But, this 1/3rd part isn’t even worth this much and we also can’t give this much. But, we just don’t know what to do. Can anyone guide what can be done here?

March 20, 2025 at 12:43 pmSo far as my knowledge goes any property left behind by the father is divided equally amongst his children my suggestion is to discuss it amongst yourself and reach an out of court compromise and submit the settlement in court-

March 21, 2025 at 4:07 amJust noticed you mentioned 1/3 part of property is not 15 lacs but I understand the father had five children so the property will be divided amongst five (recent changes in law gives equal rights to daughters too)

March 20, 2025 at 1:00 pmYour father’s legal heirs (widow, children and mother, assuming you are Hindu) will have to be added on record and the case will continue as it is.
Would recommend you hire a good local lawyer to look into the record and advice you further, as property suits require a detailed study of all documents.
