AHi,
We are struggling for a family property matter for long time.
After investment, we got legal ownership (registered deed) in my mother name.
But possession is with my chachi (aunt) who is claiming 50% right and has filed a civil case against my mother.
How to approach this?
– Negotiation – have tried multiple times in past, 2022 – chahci agreed that she will vacate in 2yrs with 25% proceeds (Sales – cost related to get title clear and taxation) , but then made a u-turn last yr. We offered more than 25% proceeds for settlement, but she didn’t agree and demanding 50% stake and that we just bifurcate it into half and put boundary wall (etc etc unnecessary demands, she just want to stall)
– legal case- we thought about it, but given complexity and long term nature, we did not decide but she files case against us without even telling and put wrong correspondence address
– selling at lower rate- we tried this to sell at lesser than marked rate as last resort, but due to this civil case, it has also been stalled.
Kindly advise..
