We are a family of four brothers. The eldest brother has passed away, and his family consists of his wife, his widowed daughter-in-law, and her son. The second and third brothers have their respective familiesโ€”wives, one son, and one daughter each. The fourth brother, i.e., my father, the youngest, has no son, only me (his daughter).
Currently, there has been no formal partition of the ancestral property, and we all live together under one roof. However, discussions about partition have started. My mother fears that when the time comes, the others will argue that my father doesnโ€™t need a separate house to live and he shall continue to live in our ancestral home since he has no son, implying that I will eventually marry and leave.
I want to understand my legal rights in this situation. Does the absence of a son in my family affect our claim? As a daughter, what rights do I have in the family property? Any legal insights or similar experiences would be helpful.

From a legal standpoint, your gender(or your existence) has zero effect on your father’s claim to his share of ancestral property.
