April 11, 2025 at 2:51 amHello,
I want to ask the lawyers of indian courts here or anyone who is well informed in the matter i am about to ask here.So i saw a review on google map where a man was denied the restroom(toilet) by a hotel. He did not book anything there he just had to pee very badly and he asked a hotel to let him use their toilet and they refused.
Later he posted review for that hotel saying that in india hotels can not refuse anyone who want to use their toilet or is asking for water for themselves or their pet.So my question here is,
Is there any Indian law or act which give right to use a hotels toilet to anyone regardless of any booking?
Can hotels refuse anyone to use their toilet within booking ?
Or is there any right given to people that they can use toilet of any hotel in enemrgency and can not.be refused by hotels. -

April 11, 2025 at 3:42 amIn India, the Indian Sarais Act of 1867 mandates that hotels and lodges provide free access to washrooms and drinking water to passersby, regardless of whether they are guests or notBut this works only on registered hotels with some proof to say they provide accommodation [you’ll need to obtain various permits and licenses, including a building permit, fire safety permit, police license, health trade license, and business registration.ย You’ll also likely need an FSSAI license for food services, GST registration, and potentially others depending on the hotel’s specific features and location]
So they must but the punishment is only fine so …

April 11, 2025 at 4:35 amThe Supreme Court has reiterated that hotels are public places and therefore access to restrooms to the public is mandatory in many cases. -

April 11, 2025 at 7:55 amNAL.If you are well-dressed for that specific hotel space, you can walk into any hotel directly and go to the toilet. You don’t need to worry about asking anyone. When I was younger, when this law wasn’t even there, I drove to the Marriott Hotel Juhu, Mumbai, gave the car to valet, and walked in for a #2. However, there was only tissue paper and no jet, so that was the first and last time I did that. Btw I saw later than guest rooms have jet, just the public ones at reception level make do with tissue.
But I have walked into restaurants confidently and used the washroom for #1 many times. You don’t need to ask. Just be confident and ensure your behaviour and clothes don’t look out of place.
