Question. What if a couple starts dating when they were both minors but then at some point of the relationship one turns adult?

I’ve always found the laws surrounding this issue to be vague, and despite seeking clarification, I’ve never received a satisfactory answer. Is this type of relationship outright illegal, or are there specific age gap considerations that come into play?

Don’t do anything sexual untill both are over 18.

There are many cases where both boy and girl are in prision under pocso because both were minor.

I was in same boat when I was with my highschool crush. We didn’t do anything till we were both 18.

(We didn’t do anything after that too. And just to be safe I still haven’t done anything.)

The laws of POSCO can need bent is a few ways. Just remember, of a girl is under 18, she’s almost always a victim even if she does things consensually. Because the age of consent is 18 and as she is not 18, she could not give legally valid consent. On the other hand, the boy can be charged with sexual assault, rape and sex with a minor, even if he himself is under 18, if the girl is also a minor. Because even consensual sex is statutory rape, since the girl hasn’t attained age of consent. And due to many heinous acts committed in the past by underage boys, the law had been changed to treat boys older than 16 as adults depending on the nature if the crime and courts generally assume boys of all ages are capable of aggression. He gets victim treatment in POSCO only if the girl is older than 18.

Legally, i don’t think the court recognises any relationships except marriage. But in terms of legal retributions, the age of the girl plays a major role.

With so much groomers around who know exactly how to exploit little girls at their tender age these POSCO laws are very much needed.

If both are minors than also parents can file case and put guy in Jail under POSCO. which is misuse of law but nothing can be done.

if there is a physical relationship, the minor’s parents/legal guardian can always bring a case of rape (consent does not matter when a minor is involved).
