Hi, I’m an NRI living abroad (location undisclosed for privacy reasons). Today, an old acquaintance from my engineering college (someone I’m connected with on Facebook) called me out of the blue and urgently asked for money for a court case.

They’ve offered to provide their passport, Aadhaar, and other IDs, but I’m wary about this being a scam or a situation where I might not get the money back.

Before I make any decisions, I’d like to know:

        1. What legal steps can I take to verify their identity and the authenticity of their claim?

2.If I decide to help, what kind of documentation or legal safeguards should I request to ensure I can recover the money if needed?

3.Are there any specific legal considerations or common pitfalls I should be aware of in such situations?

Would appreciate any advice from those with legal expertise or experience in handling such cases. Thanks!

Simply avoid. Even after taking all the necessary steps, you are gonna lose that money.
So, if you are OK with it, then and only then, go ahead.

Lawyer here: Draft an agreement laying down all the details of the friendly loan being extended by you to your friend and get him to sign, notarise and register this agreement. Take few post-dated cheques from your friend as a form of security and the cheque numbers have to be mentioned in the agreement along with the reasons for issuance of the same. If your friend goes back on his word to repay you later, you may deposit the cheques for clearance and start cheque bounce proceedings if necessary.

NAL – a few questions for you:

When was the last time, you spoke with this “friend” of yours?
What’s your POA to get the money back, if you decide to “help” him? I’m sure learned people on this sub might help you formulate it.
However, are you ready to go through all the trauma that’ll follow while you are chasing him for your own hard earned money?

In my personal experience, some people in India(not generalising) think guys living abroad earn so much, they even shit money. So they can spare a few thousand bucks and not care about it.

This person might be in genuine trouble, but if he cannot handle it himself now, what makes you think it’ll be better later?

              Food for thought!

Give the money ONLY if you never expect it to be returned!

If you want your money back – best way is NOT give it in the first place in exchange for their passport or their life!

Might be a scam… Someone made a fake profile of my cousin and asked for money to multiple family member’s. Check with other friends and that guy personally.

Tell him you can’t. Either you’ve got loans to pay or money is stuck in the stock market.

Money given to friends or family is as good as donated.

Bhai this is a recent acquaintence? Just say no, block, ghost.. why are you putting so much pressure on yourself to be a saviour?

If you connected with him recently, why would he approach you of all people? Think: if you are in trouble- you are likely to approach your close friends, family or acquaintences?

If he’s having to approach you: that could mean only one of two things:

                        1. He’s burnt bridges with people he’s close to by taking money in the past and not repaying

                        2. This is a scam

Both are giant red flags. Great reasons for you to not entertain this.. and your welcome 🙂
