        Today I received a summon from a small causes court regarding a motorcycle accident that I was not involved in. But I was the first owner of the motorcycle and my name somehow got linked to the case.

        Background:

        I sold the motorcycle in December 2020 and transferred ownership (RC) immediately after finalising the deal.

        The current RC and Insurance Policy are in the buyerโ€™s name (the one who caused the accident) at the time of the accident.

        I recently found out that the buyer gave an old insurance copy to the police which led to my name being dragged into this.

        Current situation:

        The summon is filed by the victimโ€™s lawyer and they are claiming damages amounting to 50L

        My name appears at the very beginning in this summon and im very concerned about this, they have named me as the owner of the vehicle and named the current owner as second listing.

        The opposing party lawyer says it was a mistake on their end and I shouldnโ€™t have to worry about this, he told me to ignore the summon but was not willing to change the summon.

        My questions:

        1. I consulted a lawyer of my own and she said we should contest this summon to clear my name of any legal outcome. Is this the right course of action or should I ignore the summon as I am in no way responsible or related to the accident.

        2. Can the court hold me liable even though the RC and insurance were in the new owners name

        3. Has anyone dealt with a similar case? What was the outcome?

          You might need a lawyer, if you get one make sure you file a counter claim for trouble and trauma this case will cause you seek the same amount from other party or atleast 5 to 10 lakh.

          Have all your papers ready, it wasn’t your fault, you should be fine, but this will waste some of your time for no reason.

          If his name there on RC and Insurance then he’s responsible.

              That was my thought as well, I find it very absurd and malicious since I was named first in that summon and their lawyer told me to ignore this summon yet he refused to remove my name from it. His argument was the insurance company would deal with it and you donโ€™t have to worry about this.

              Note: The lawyer representing the victim is a relative of the person who caused the accident (buyer)

                  They are just wasting courts time so insurance company think it will take a lot of money and litigation and they pay.
                  They should be taught a lesson with a counter claim.
