May 7, 2026 at 1:08 pmI purchased a Whirlpool refrigerator from Khosla Electronics on EMI. The first unit was delivered on April 23 and found Dead on Arrival (DOA) with a crushed cooling plate (fire hazard).Whirlpool officially closed my NCH grievance on May 6 claiming the replacement was “completed,” even though the new unit had not been unboxed.
On May 7, the replacement was unboxed and also found to be damaged with paint chipped to bare metal and a warped internal tray. The technician refused to document this damage on the job sheet and walked out without my signature. A Khosla salesman then joined a call and verbally harassed/disrespected me for requesting proper documentation.
I have filed a chargeback dispute with SBI for the 21,500 transaction. I have all evidence, including photos, call recordings, and video recordings of the unboxing and tech’s refusal.
Questions:
Is the installation legally incomplete since I never signed the report?
Does Whirlpool’s false closure of the NCH portal before unboxing constitute an Unfair Trade Practice?
Can I claim compensation for mental agony and harassment via E-Daakhil?
Will plugging the fridge in legally signal “acceptance” and hurt my chargeback case?
