March 19, 2025 at 2:55 pmMy grandfather had given us access to the entire shamlat land, which was under his control. He made an affidavit in my and my sister’s name. But my Chacha Ji and Taya Ji have filed a case against us. (My chacha ji and taya Ji had power of attorney over the entire malkit and abadi land before my fatherโs death.)After my fatherโs death, my grandfather equally divided the malkit and abadi land among the three brothers, but he refused to give access to the shamlat land to my taya ji and chacha ji coz they were being greedy at that time.
Someone told us tht if we lose the case, shamlat land will be given to the panchayat, but our personal lawyer assured us there’s nothing to worry abt ! Can someone tell me is it true that the shamlat will be given to the panchayat if we lose the case ?

March 19, 2025 at 3:04 pmsee i think if a legal case is going on and in case the dispute isn’t settled, then the government will take control over your land and probably auction it..-

March 19, 2025 at 3:21 pmOur lawyer looks shady to me, which is why I decided to ask this here,he even told us that if we smhow lose the case, the gvrnment will probably take control of other people’s shamlat land in our village as wellย ( I mn why would they take control over other’s shamlat unnecessarily? )

If a private individual possesses such land, it is either through a valid purchase with government approval or unauthorized encroachment.In an inheritance dispute, if there is no clear documentary evidence proving private ownership of the Shamlat land, initiating court proceedings may be risky and could lead to adverse consequences.

March 19, 2025 at 7:16 pmTotal shamlat land is around 1 acre, and patwari told us that it cannot be registered under any individual’s name. Even though my grandfather had already registered it in my name, my name does not appear on the Farad instead, it shows that my grandfather owns it. He made a legal affidavit in my name. There’s only one documentary evidence that he gave us the access to own it
