We had a booking through Zomato which was providing us 15% discount on bill payment.The restaurant levied 10% service charge on the total bill which we asked them to remove. Now the manager said that if we will get the SC removed, they will not accept our payment via Zomato.
Now I just want to ask, does the restaurant has any legal standing to do this? As this has been among a common occurrence among restaurants

February 13, 2025 at 4:17 pmAnd consumer court, a resturant cannot enforce Service Charge even if they specify anywhere. It’s fully on the customers choice if they want to pay the SC.

February 13, 2025 at 5:07 pmThis has become the norm at most places now. They stick it in our face by writing “We levy 10% service charge/staff contribution charges”. So, if you ask to remove, they simply deny and point towards the plaque. I always try my best to get the service charge removed, but in a group it becomes awkward to argue over it when the waiter adamantly refuses. So I just let it slide because I don’t want to spoil the mood for others and come off as someone who is messing with the waiter. I know I’m asking for the right thing but this is how they get away with it.Most places will not let go of service charges and will fight you for it. The legal way is also not guaranteed to give you any solution. I’ve tried it as well. The NCH complaint was simply closed stating no response from restaurant which is absurd and there was no way to escalate it further.
Plus, the restaurants have smartly changed it to ‘Staff contribution’ so if you file a complaint, they have the answer that you paid for staff contribution and not a ‘Service charge’.
Honestly, dining out is a pain these days and just not worth it with the fake cheese, Paneer, adulterated food, staff contribution, expensive af dish rates, and added taxes. Not to mention, the dine out coupons are also not always accepted by the establishments.
Better to cook at home.-

February 14, 2025 at 4:52 amI think it’s called out in Zomato offer T&C too, that service charge is mandatory. The zomato offer takes that into account, and hence most resturant will not allow you to avail the Zomato offer if you remove the service charge.-

February 14, 2025 at 6:39 amNext time ask the waiter to remove SC. Once they provide you the updated bill, donβt tell them the mode of payment, make an excuse and ask them to come back in 5 mins. Pay the bill on Zomato or Swiggy. When they are back, show the payment receipt.This way theyβll not get a chance to make their stupid imposition.
I have tried this couple of times in swiggy/dineout.
